Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the OneVerse device, mobile and web applications, and related services (collectively, the "Service"), operated by Brahmaverse ("we", "us", "our").

By creating an account, purchasing a device, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Eligibility & Accounts

• You must be at least 16 years old to create an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate, current information and to keep it updated.
• We may suspend or terminate accounts that provide false information or violate these Terms.

3. The Service

OneVerse provides an AI-powered recording device and companion applications that transcribe, summarize, and organize spoken conversations. Features, availability, and pricing may vary by plan and region and may change over time.

AI-generated transcripts and summaries are produced automatically and may contain errors, omissions, or inaccuracies. You are responsible for reviewing and verifying any output before relying on it for important decisions.

4. Recording Consent & Lawful Use

Recording laws vary by jurisdiction. In many places, you must obtain consent from all parties before recording a conversation. You are solely responsible for complying with all applicable wiretapping, recording, and privacy laws.

• Do not use the Service to record individuals without the legally required consent.
• Do not use the Service to surveil, harass, stalk, or violate the privacy of others.
• Do not record or process content that infringes third-party intellectual property or confidentiality obligations you owe to others.

OneVerse is not liable for your failure to obtain required consent or otherwise comply with recording laws applicable to you.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service or device firmware.
• Use the Service to build a competing product or to train a competing AI model.
• Interfere with or disrupt the integrity or performance of the Service, including through malware or excessive automated requests.
• Circumvent usage limits, licensing restrictions, or access controls.
• Use the Service for any unlawful, defamatory, or harmful purpose.
• Resell or sublicense access to the Service without our written consent.

Violation of this section may result in immediate suspension or termination of your account, in addition to any other remedies available to us.

6. Your Content & Ownership

You retain all ownership rights to the recordings, transcripts, notes, and files you create using the Service ("Your Content"). We do not claim ownership over Your Content.

You grant us a limited, non-exclusive license to process, store, and transmit Your Content solely to provide and improve the Service, in accordance with our Privacy Policy. We do not use Your Content to train AI models.

You represent that you have all necessary rights and consents to upload and process Your Content through the Service.

7. Subscriptions, Payments & Refunds

• Paid plans are billed in advance on a monthly or annual basis and automatically renew unless cancelled before the renewal date.
• Device purchases are billed at checkout; shipping and applicable taxes are shown before you confirm your order.
• You may cancel a subscription at any time; cancellation takes effect at the end of the current billing cycle.
• Devices may be returned within 15 days of delivery in original condition for a full refund, subject to our return policy shown at checkout.
• Except where required by law, subscription fees are non-refundable for partial billing periods.

8. Our Intellectual Property

The Service, including its software, device design, models, trademarks, and branding, is owned by Brahmaverse and protected by intellectual property laws. Except for the limited rights expressly granted to you to use the Service, no rights are transferred to you.

9. Third-Party Services

The Service may integrate with third-party applications (such as calendar or storage providers) that you choose to connect. Your use of those integrations is subject to the third party's own terms and privacy practices, which we do not control.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED TRANSCRIPTS OR SUMMARIES WILL BE ACCURATE, COMPLETE, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.

Hardware devices are covered by a separate limited warranty provided at purchase, covering manufacturing defects for the stated warranty period.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAHMAVERSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold Brahmaverse harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, pose a security risk, or if required by law, with notice where reasonably possible.

Upon termination, your right to use the Service ends immediately. Sections concerning ownership, disclaimers, liability, and dispute resolution survive termination.

14. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, unless otherwise required by applicable local law in your jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
